Notice of Decision: Friends of the High Lakes Repeater Shed
On March 17, 2010, Alfred G. Vazquez, District Ranger of the Almanor Ranger District signed a Decision Memo authorizing the constructions of a 5’ X 7’ repeater shed with a radio tower not to exceed 40’ and with non reflective solar panels to provide emergency communications for the Friends of the High lakes (ham radio operators), federal and state agencies, and the installation of a gate on the access route to provide security for associated equipment, located in T25N., R5E., sw1/4 section 15. Copies of the Decision Memo are available at the Almanor Ranger District, Chester, California. Additional information regarding this decision can be obtained from Jane Goodwin at 530-258-2141 or via email at jmgoodwin@fs.fed.us.
This decision was not subject to appeal pursuant to 36 CFR 215 (June 2003) because: The project is categorically excluded from documentation in an EA or EIS pursuant to FSH 1909.15, Chapter 30, section 31 [36 CFR 215.12(f)]. Note: On July 8, 2009, the United States District Court for the Eastern District of California lifted the injunction it had issued in Earth Island Institute v. Pengilly in response to the Supreme Court’s March 3, 2009, ruling in Summers v. Earth Island Institute. With the lifting of that injunction, sections 215.12(f) and 215.4 of the appeal regulations at 36 CFR 215 are again in effect and categorically excluded (CE) decisions are exempt from notice & comment and appeal requirements. This decision may be implemented immediately.
