Water quality notice

IMPORTANT INFORMATION ABOUT YOUR DRINKING WATER

April 2010

The Plumas Eureka Community Services District Domestic Water System Has Levels of Arsenic Above the Federal Drinking Water Standard

Our domestic water system recently violated the new federal drinking water standard for arsenic. Although this is not an emergency, you have the right to know what happened, what you should do, and what we are doing to correct this situation.

What happened?

The USEPA standard, enacted in January 2006, lowered the maximum contaminant level (MCL) of arsenic from 0.050 milligrams per liter (mg/l) to 0.010 mg/l. We routinely monitor for the presence of drinking water contaminants throughout the year. Our results indicate the 2010 first quarter average (Jan, Feb, Mar) for Well #1B is 0.0103 mg/l and Well #2 is 0.0133 mg/l, both are above the current federal standard.

What should I do?

You do not need to use an alternative water supply (e.g., bottled water).

This is not an emergency. If it had been, you would have been notified immediately. However, some people who drink water containing arsenic in excess of the MCL over many years may experience skin damage or circulatory system problems, and may have an increased risk to getting cancer.

If you have other health issues concerning the consumption of this water, you may wish to consult your doctor.

What is being done?

PECSD is continuing to work with Plumas GeoHydrology in sampling the surrounding groundwater. The testing results have identified two possible places where lower arsenic levels may be found in the groundwater. We will be drilling two test wells within PECSD's boundaries sometime in late spring or early summer to determine if these locations prove to be acceptable drinking water sources.

ORDINANCE No: 5070

MARCH 2010 REVISION

AN ORDINANCE OF THE BOARD OF GRIZZLY LAKE RESORT IMPROVEMENT DISTRICT AMENDING THE SCHEDULES OF WATER AND SEWER CHARGES

AND OTHER FEES

WHEREAS, the Board of Directors of the Grizzly Lake Resort Improvement District is committed to providing water and sewer service to customers as efficiently and inexpensively as possible; and

WHEREAS, the Board of Directors has determined that in order to maintain the District's solvency and ensure that services can continue to be provided, it is necessary to amend the District's schedule of water and sewer rates; and

WHEREAS, Article 13D of the California Constitution (adopted by the voters as part of Proposition 218) requires that notice of any rate increase for water or sewer service be provided to customers affected by the rate increase, and requires that a hearing be held on the rate increase and provides that no rate increase may be implemented if a majority of a public agency's customers object in writing to the proposed rate increase; and

WHEREAS, the District did mail notice of a hearing on water and sewer rate increases to affected customers in compliance with applicable law, did hold the hearing, and did not receive written protests from a majority of customers; and

WHEREAS, Section 5471 of the California Health & Safety Code authorizes water and sewer rates to be increased through the adoption of an ordinance approved by a four-fifths vote of the District's Board of Directors;

BE IT ORDAINED by the Board of Directors of the Grizzly Lake Resort Improvement District that Section 5070 et seq of the District's code of ordinances, concerning water and sewer rates and other charges, is hereby amended to read as

All rates, fees and charges for water and sewer services proscribed and set forth in all previously adopted ordinances, resolutions and orders by the Grizzly Lake Resort Improvement District are hereby repealed.

Section 5070.41  General Provisions

The Board of Directors shall review the District's rate structure each year, prior to the approval of the Fiscal Year Budget. The Board shall adjust all rates and charges to assure solvency and compliance with outstanding contractual obligations relating to services, subject to compliance with applicable law, including but not limited to Proposition 218.

Section 5070.42  System Maintenance Standby Charges

System Maintenance Standby Charges shall be charged and collected from the owners of all vacant lots in the District. The charges shall be as set forth in Section 5070.49, Schedule of Fees, Rates and Charges, under the item "System Maintenance Standby."

Section 5070.43  Description of Services and Billing Procedures

Services for improved lots are comprised of Water and Sewer (if applicable). Services for unimproved lots are comprised of Sewer Standby fees and Water Standby fees. In the case of rental property, the property owner name listed on Plumas County Tax Records is considered the party responsible for payment of all service fees.

(a) All charges and rates for services are based on annual fees and are billed on a monthly basis by the District. All charges for services and facilities shall be listed on one statement and collected together. The obligations may be pre-paid, annually, semi-annually, or quarterly at the option of the property owner.

(b) Payment is due by the 25th of each month from the date of the billing. If not paid by the 25th the account will be considered past due, at which time a Statement and a Past Due Notice shall be forwarded. Failure to pay any portion of the statement will be considered as a default on the account.

Section 5070.44  Procedure Prior to Discontinuing Service(s)

(a) Past due notice shall include information regarding the following subjects:

(1) Arrangements to make payments.

(2) File a complaint or request an investigation regarding services or charges.

(3) Request information regarding financial assistance.

(b) In the event payment is not received within 30 days after the mailing of the Past Due Notice, a Notice of Intent to Shut Off Services shall be forwarded. Said notice shall be sent by Certified Mail, Return Receipt Requested. A fee of $25.00 shall be charged to the delinquent account.

(c) After the expiration of the additional (30) days a Second Notice of Intent to Shut Off Service will be mailed in the similar manner as proscribed in paragraph (b), and in addition a copy of the notice shall be posted on the dwelling property. If payment is not received within fifteen (15) days a final 48 Hour Shut Off Notice shall be forwarded and posted. If full payment is not received, service will be discontinued.

(d) GLRID service rates are flat rates, charged on a fiscal year basis, predicated on issuance of the Will Serve Letter. Therefore billing for services will continue.

Section 5070.45  Basic Penalties

If payment is not received by the 25th of the billing month a late charge of $5.00 will be levied on the account. The late charge will be levied each month there is a balance past due. If no arrangement for payments are made the procedure to discontinue service will start. If services are discontinued the Board of Directors may require a Utility Deposit of (3) three months services prior to reconnection of services.

Section 5070.46  Tapping or Connections - District permission required

No person shall tap, open valves and hydrants, or connect with any water main or pipe which forms any part of the system of the waterworks of the Grizzly Lake Resort Improvement District, without first notifying and obtaining written permission to do so from the General Manager of the District, who shall issue no such permit to or for any person or firm whose indebtedness' to the District for water or other charges is delinquent. Failure to notify and obtain written permission shall be subject to a penalty of $250.00 for each such unauthorized tapping or connection. Each day of such unauthorized use shall be a new unlawful tapping or connection for the purposes of this section.

Section 5070.47  Collection Methods

If payment is not received within the fiscal year of the billing, the District may employ any and all legal methods to collect outstanding debts to include recording certificates specifically the amount (s) due and recording of which constitutes a lien on the property.

Section 5070.48  Days and Hours restrictions on Termination

The District shall not, by reason of delinquency in payment for any services, cause cessation of the services on any Saturday, Sunday, legal holiday, or at any time during which the business office of the District are not open to the public.

Section 5070.49  Schedule of Fees, Rates, and Charges.

The following are the fees, rates and charges which will be applied thirty (30) days from the effective date of this ordinance, and shall remain in effect until further review by the sitting Board of Directors.
