Opportunity to Give Scoping Comments on the North Eagle Lake, Champs Flat, and Lower Pine Creek Allotments Grazing Management Project

The Eagle Lake Ranger District (ELRD) of the Lassen National Forest (LNF) is initiating scoping for the North Eagle Lake, Champs Flat, and Lower Pine Creek Allotments Grazing Management Project. These allotments cover 74,569 acres of Forest Service administered lands and are located approximately 15 miles northwest of Susanville, CA (centered at Logan Mountain). The allotments include part of the Pine Creek Valley, Champs Flat, Antelope Valley, Dow Butte and extend to a small portion of the west shore of Eagle Lake. The project area includes portions of Townships (T) 31, 32 and 33 North (N), Ranges (R) 9, 10 and 11 East (E) of the Mount Diablo Meridian. With this project, the Lassen National Forest is proposing to authorize continued livestock grazing with changes to management strategies, changes to fences and water developments, and aspen enhancement treatments.

Copies of the proposed action, purpose and need, and decision to be made, are available at the Eagle Lake Ranger District office located at 477-050 Eagle Lake Rd, Susanville, CA 96130. Comments should relate to the proposed action and identification of any issues about the anticipated effects from this proposed action. Responses must be in a written format to have standing during the objection period for this project. Please respond on or before March 21, 2018 so your input can be considered as we move into the next phase of the National Environmental Policy Act process.

The North Eagle Lake, Champs Flat, and Lower Pine Creek Allotments Grazing Management Project is subject to the Pre-decisional Administrative Review (Objection) process as described under 36 CFR 218, subparts A & B for non-Healthy Forests Restoration Act (HFRA) projects. To be eligible to object to an environmental assessment under this regulation, an individual or organization must submit timely, specific written comments regarding a proposed project during scoping or any other public comment period established by the responsible official (36 CFR 218.5(a)). The commenter is responsible for providing literature cited in their comment, as well as the full citation and an explanation of how each piece of literature cited applies to the proposed action. A 30-day legal notice and comment period will be provided for this project. A 45-day objection period prior to a decision being made will follow rather than a post-decisional appeal period.

LASSEN COUNTY BOARD OF SUPERVISORS

The Lassen County Planning Commission held a public hearing on February 7, 2018, and is recommending that the Board of Supervisors approve the following rezone, and the Land Conservation Committee held a meeting on January 17, 2018, and is recommending that the Board of Supervisors approve the following Land Conservation (Williamson) Act contract:

Project: The Board of Supervisors will consider applications by Five Dot Land & Cattle Co. to rezone and enter lands within Lassen County into a new Land Conservation (Williamson) Act contract. If approved, the contract would affect four assessor’s parcel numbers (APNs) that contain approximately 320 acres of contiguous, non-irrigated land. Section 1(e) of Exhibit A of Board Resolution #12-050 requires that the Board of Supervisors hold a public hearing to consider the Land Conservation Committee and Planning Commission’s recommendations and render its decision on the rezone and agricultural preserve applications. In conjunction with Agricultural Preserve #2018-001 and Rezone #2018-001, the Board of Supervisors will also consider an application by Five Dot Land & Cattle Co. and John E. Hanson, Jr. and Darcy H. Hanson to adjust the lot lines between three parcels, of which the subject APNs are a part. Section 2(b) of the above board resolution requires that any lot line adjustment approved by the Technical Advisory Committee on lands under contract be conditioned upon the Board of Supervisors making the required findings in accordance with Government Code Section 51257. The Technical Advisory Committee conditionally approved Lot Line Adjustment #2017-012 at its January 4, 2018, meeting.

Location: The subject APNs are located adjacent to California State Route 139 in the Willow Creek Valley area of Lassen County, approximately 13 miles northeast of Susanville, CA.

A.P.N.s: 091-060-12, 091-060-14, 091-060-15, and 091-100-29.

General Plan Designation: The subject APNs are designated “Intensive Agriculture” by the Lassen County General Plan, 2000.

Existing Zoning: The subject APNs are zoned A-1-H (General Agricultural District, Highway Combining District [within 300 feet of the centerline of California State Route 139]) and U-C-2 (Upland Conservation/Resource Management District).

Proposed Zoning: The applicant proposes to rezone the subject APNs into the U-C-2-A-P (Upland Conservation/Resource Management District, Agricultural Preserve Combining District) zoning district.

NOTICE is given that a Mitigated Negative Declaration has been prepared setting forth the findings that the following proposed action, Diamond Mountain Watershed Restoration and Wildland Urban Interface (WUI) project, will have a less than significant adverse effect on the environment. The project area is generally located 7 miles south of Susanville, CA; 2 miles west from Janesville, CA, and abuts the Plumas National Forest on the south. It includes Township (T) 29 North (N), Range (R) 11 East (E), Sections 31 and 32; T28N, R11E, Sections 1 through 6, 10 and 11; T28N, R12E, Sections 4 through 6 and 8 through 16; T29N, R12E section 34 of the Mount Diablo Meridian (Figure 1). The project planning area encompasses 8,195 acres of NFS lands located within the Diamond Management Area (MA 33), as identified in the LNF Land and Resource Management Plan (LRMP).

This document is proposed to be adopted and has been filed with the Honey Lake Valley Resource Conservation District (RCD). It is now available for inspection and review. The review period for this Mitigated Negative Declaration is from March 6, 2018 through April 4, 2018. Separate sealed BIDS for the CITY OF SUSANVILLE 2012 STIP PAVEMENT PROJECT ‘FC’ located on various local streets within the CITY OF SUSANVILLE, described by title as the 2012 STIP PAVEMENT PROJECT ‘FC’ and having Project Number 17-01 will be received by the CITY of Susanville at the office of the CITY CLERK, 66 North Lassen Street, Susanville, CA  96130 prior to 2:00 P.M., March 8, 2018 and then at said address publicly opened and read aloud in the CITY Hall COUNCIL Chambers. The CONTRACT DOCUMENTS may be examined at the following location: CITY PUBLIC WORKS OFFICE, 720 South Street, Susanville, CA 96130.

The WORK generally consists of: PLACEMENT OF A HOT MIX ASPHALT PAVEMENT OVERLAY AT VARIOUS LOCATIONS WITH AREAS OF STRUCTURAL SECTION REPAIR, REMOVAL OF DAMAGED PAVEMENT, RE-ESTABLISHMENT OF PROPER CENTERLINE AND CROSS SLOPE GRADES AND VARIOUS PORTLAND CEMENT CONCRETE IMPROVEMENT INCLUSIVE OF ADA ACCESSIBILITY RAMPS, CURB, GUTTER, SIDEWALK, DRIVEWAY APPROACHES AND VALLEY GUTTERS, and all other WORK necessary to complete the PROJECT. The CONTRACT DOCUMENTS may be obtained from the CITY Public Works Department located at 720 South Street, Susanville, CA  96130 upon a non-refundable payment of $25.00 for each set.  An additional non-refundable payment of $10.00 will be required for mailing the CONTRACT DOCUMENTS.

In accordance with the provisions of California Public Contract Code Section 3300, the CITY has determined that the CONTRACTOR shall possess a valid CLASS A OR C12 CONTRACTORS LICENSE at the time that the CONTRACTOR is selected. Failure to possess the specified license shall render the bid as non-responsive and shall act as a bar to award of the CONTRACT to any bidder not possessing said license at the time of award. A City of Susanville Business License is also required of all successful bidders.

The CONTRACTOR may elect to receive one hundred percent (100%) of payments due under the CONTRACT DOCUMENTS from time to time, without retention from any portion of the payment by the CITY by depositing securities of equivalent value with the CITY in accordance with the provisions of Section 10263 of the California Public Contract Code. Such securities, if deposited by the CONTRACTOR, shall be valued by the CITY, whose decision on valuation of the securities shall be final. Securities eligible for investment under this provision shall be limited to those listed in Section 16430 of the California Government Code, and Section 10263 of the California Public Contract Code.

The CONTRACT DOCUMENTS specify the scope of the WORK and many other conditions which include, but are not limited to, the wages to be paid to all workers employed in the execution of the CONTRACT. It shall be mandatory for the successful bidder and any SUBCONTRACTORS thereof, to pay not less than the prevailing wages to all workers employed in performing this CONTRACT in accordance with Sections 1170 to 1781 of the Labor Code. Neither the CONTRACTOR nor SUBCONTRACTORS shall engage in or permit discrimination in employment of persons because of race, color, national origin, ancestry, or religion.

INFORMATION FOR BIDDERS

BIDS will be received by the CITY of Susanville (herein called the CITY), at 66 North Lassen Street, Susanville, CA 96130 prior to 2:00 P.M., March 8, 2018. All BIDS must be accompanied by the Statement of Qualification as defined in the Supplemental General Conditions in Section 5. Any BID not accompanied by the Statement of Qualifications will not be considered for selection. The CITY will provide to BIDDERS upon request prior to bidding, all information pertinent to, delineates and describes, the land owned and rights-of-way acquired or to be acquired.

Each BID must be submitted to the CITY CLERK in a sealed envelope, addressed to the CITY of Susanville at 66 North Lassen Street, Susanville, CA 96130. Each sealed envelope containing a BID must be plainly marked on the outside as BID for PROJECT NO. 17-01, 2016 STIP PAVEMENT PROJECT ‘FC’ and the envelope should bear on the outside the name of the BIDDER, the BIDDER’S address, and the BIDDER’S license number if applicable. If forwarded by mail, the sealed envelope containing the BID must be enclosed in another envelope addressed to the CITY at 66 North Lassen Street, Susanville, CA 96130.

At any time up to three (3) working days prior to BID opening, the CITY or CITY’S ENGINEER may issue ADDENDA to the PLANS and SPECIFICATIONS. The same shall be made available to those persons who have obtained a CONTRACT DOCUMENTS package from the CITY. The receipt of the ADDENDA shall be noted on the bid and will become part of the CONTRACT DOCUMENTS.

BIDDERS must satisfy themselves to the accuracy and completeness of the BID SCHEDULE by examination of the site and a review of the DRAWINGS and SPECIFICATIONS including ADDENDA. After BIDS have been submitted, the BIDDER shall not assert that there was a misunderstanding concerning the quantities of WORK or of the nature or scope of the WORK to be done.

Individual BIDDERS shall sign the BID with their full name and address. A partner of a Partnership submitting a BID shall sign the BID with his or her full name and the name and address of every member of the Partnership shall be given. A duly authorized officer(s) of a corporation submitting a BID shall sign the BID with his/her/their full name(s) attested by the corporate seal, and the names and titles of all officer(s) of the corporation shall be given on the BID.

The CITY will not consider for award more than one BID from an individual, firm, partnership, corporation, or association under the same or different names. A conditional or qualified bid will not be accepted. The CITY may waive any informalities or minor defects or reject any and all BIDS. Any BID may be withdrawn prior to the above scheduled time for the opening of BIDS or authorized postponement thereof. Any BID received after the time and date specified shall not be considered. No BIDDER may withdraw a BID within sixty (60) days after the actual date of the opening thereof. Should there be reasons why the CONTRACT cannot be awarded within the specified period, the time may be extended by mutual AGREEMENT between the CITY and the BIDDER.

This project is Federally funded. All applicable Federal and State laws, ordinances, and the rules and regulations of all authorities having jurisdiction over construction of the PROJECT shall apply to the CONTRACT throughout. Some of the laws regarding wage rates, travel and subsistence payments, payroll records, apprentices, working hours and workers compensation are specified under the General Conditions. The CONTRACT DOCUMENTS contain the provisions required for the PROJECT. Information obtained from an officer, agent, or employee of the CITY or any other person shall not affect the risks or obligations assumed by the CONTRACTOR or relieve him from fulfilling any of the conditions of the CONTRACT.

Each BID must be accompanied by a BOND payable to the CITY for ten percent (10%) of the amount of the BID. Once qualifications are received, and the BID prices compared, the CITY will return the BONDS of all except the three (3) lowest responsible BIDDERS. Lowest responsible will also include “most qualified.” When the AGREEMENT is executed the BONDS of the two (2) remaining unsuccessful BIDDERS will be returned. The BID BOND of the successful BIDDER will be retained until the PAYMENT BOND and PERFORMANCE BOND have been executed and approved, after which it will be returned. The BID BOND must be executed on the BOND FORM included in the CONTRACT DOCUMENTS.

A PERFORMANCE BOND and a PAYMENT BOND, each in the amount of one hundred percent (100%) of the CONTRACT PRICE, with a corporate SURETY approved by the CITY, will be required for the faithful performance of the CONTRACT. The PERFORMANCE BOND and the PAYMENT BOND must be executed on the BOND FORMS included in the CONTRACT DOCUMENTS. A MAINTENANCE BOND will be required of the CONTRACTOR upon completion of the WORK, and prior to final payment. The MAINTENANCE BOND shall remain in force for a period of one (1) year after the date of “NOTICE OF COMPLETION of WORK”. Attorneys-in-fact who sign BID BONDS, MAINTENANCE BONDS, or PAYMENT BONDS and PERFORMANCE BONDS must file with each BOND a certified and effective dated copy of their power of attorney. Insurance will be required according to Section 4.21 of the General Conditions.

The party to whom the CONTRACT is awarded will be required to execute the AGREEMENT and obtain the PERFORMANCE BOND, PAYMENT BOND, and all required insurance within ten (10) calendar days from the date when NOTICE OF AWARD is delivered to the BIDDER. The NOTICE OF AWARD shall be accompanied by the necessary AGREEMENT and BOND FORMS. In case of failure of the BIDDER to execute the AGREEMENT, the CITY may at its option consider the BIDDER in default, in which case the BID BOND accompanying the proposal shall become the property of the CITY.

The CITY within ten (10) calendar days of receipt of acceptable insurance, PERFORMANCE BOND, PAYMENT BOND and AGREEMENT signed by the party to whom the AGREEMENT was awarded shall sign the AGREEMENT and return to such party an executed duplicate of the AGREEMENT. Should the CITY not execute the AGREEMENT within such period, the BIDDER may by WRITTEN NOTICE withdraw his signed AGREEMENT. Such notice of withdrawal shall be effective upon receipt of notice by the CITY.

The NOTICE TO PROCEED shall be issued within ten (10) calendar days of the execution of the AGREEMENT by the CITY. Should there be reasons why the NOTICE TO PROCEED cannot be issued within such period, the time may be extended by mutual agreement between the CITY and CONTRACTOR. If the NOTICE TO PROCEED has not been issued within the ten (10) calendar day period or within the period mutually agreed upon, the CONTRACTOR may terminate the AGREEMENT without further liability on the part of either party.

The CITY may make such investigations as it deems necessary to determine the ability of the BIDDER to perform the WORK, and the BIDDER shall furnish all such information and data for this purpose as the CITY may request. The CITY reserves the right to reject any BID if the evidence submitted by, or investigation of, such BIDDER fails to satisfy the CITY that such BIDDER is properly qualified to carry out the obligations of the AGREEMENT and to complete the WORK contemplated therein.  The CITY reserves the right to reject bids at their sole discretion.

Each BIDDER and CONTRACTOR shall be licensed in accordance with the laws of the State of California including but not limited to Chapter 9, Division 3 of the Business and Professions Code. Any BIDDER or CONTRACTOR not so licensed is subject to the penalties imposed by such law. Each BIDDER is responsible for inspecting the site and for reading and being thoroughly familiar with the CONTRACT DOCUMENTS. The failure or omission of any BIDDER to do any of the foregoing shall in no way relieve any BIDDER from any obligation in respect to his BID. Further, the BIDDER agrees to abide by the requirements under Executive Order No. 11246, as amended, including specifically the provisions of the equal opportunity clause set forth in the SUPPLEMENTAL GENERAL CONDITIONS.

The CITY requests notification of discrepancies in, or omissions from, the CONTRACT DOCUMENTS if any are found by a BIDDER. A mandatory pre-bid meeting will be held to answer all questions and includes a site inspection trip for prospective BIDDERS. No contractor or subcontractor may be listed on a bid proposal or awarded a contract for public work unless currently registered with the DIR pursuant to Labor Code section 1725.5. This project is subject to compliance monitoring and enforcement by the DIR.

Each bidder shall be a licensed contractor at the time the bid pursuant to the Business and Professions Code and such license(s) shall remain in active and good standing for the duration of the contract. The bidder shall be licensed in one or more the following classifications: IICRC Certification is required for this mold remediation project; CDPH trained and certified to perform the lead abatement work; B-ASB licensure or its equivalent is required to perform the asbestos work on this project.
